Международный договор о регистрации товарных знаков Подписан в Вене 12.06.1973. Вступил в силу в 1980. Регистрация согласно договору имеет те же правовые последствия в каждом участвующем государстве, что и национальная регистрация. В отличие от Мадридского соглашения о международной регистрации от 14.04.1891, в соответствии с этим договором никакой предшествующей национальной регистрации знака не требуется. -

Мадридское соглашение ( полное название — "Мадридское соглашение о международной регистрации знаков"; подписано в 1891 г. в Мадриде с целью преодоления трудностей международной регистрации торговых марок и знаков обслуживания; соглашение упрощает процедуру подачи заявок на регистрацию товарного знака (заявитель подает только одну заявку в национальное или региональное патентное ведомство, указывая страны, в которых он испрашивает охрану, т. е. отпадает необходимость в услугах патентных поверенных в каждой из стран); в качестве даты международной регистрации принимается дата подачи заявки на международную регистрацию в стране происхождения, срок охраны — двадцать лет; международная регистрация может быть продлена на период в двадцать лет с момента истечения предшествующего периода; выполнение соглашения контролируется Всемирной организацией интеллектуальной собственности; по состоянию на начало 2007 г. к соглашению присоединились 57 стран)Syn:See: -
